1.Acceptance of these terms
By registering an account, submitting an enquiry, joining the Partner Network, subscribing to the Subcontractor Network or otherwise using services provided by ACC · Australia Construction Consultants & Associates ("ACC", "we", "us") you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the platform.
2.Eligibility & accurate information
You warrant that (a) you are at least 18 years old; (b) you are authorised to accept these terms on behalf of the firm or entity you represent; and (c) all information you supply during registration — including name, email, ABN, insurance expiry, discipline, trade and phone number — is true, current and complete. You must promptly update your details if they change.
3.Partner Network (A$700 one-off)
The A$700 Partner Network joining fee grants a digital approved-partner status, an AS4000-1997 engagement agreement, listing on the public partners directory and access to the Partner Dashboard. The fee is exclusive of GST. Fees are refundable within seven (7) days of payment only where ACC declines the application. Payments can be made by card via Stripe or by direct bank transfer to the ACC trust account (details provided during registration).
4.Subcontractor Network (A$200 per quarter)
The A$200 Subcontractor Network subscription grants recurring 90-day access to live tender opportunities on ACC projects, the standard-forms library (SWMS, JSA, ITPs and toolbox templates), toolbox-talk feeds and a public subcontractor profile. Card subscriptions auto-renew every 3 months until cancelled from the member dashboard. Bank-transfer memberships activate for 90 days once ACC confirms funds have landed and must be renewed manually. Refunds are provided only where ACC is at fault.
5.Consultant & client accounts
Consultant, client and staff accounts are provisioned by ACC. You must keep your password confidential and are responsible for all activity performed under your credentials. You must notify us immediately at
info@accassociate.com.au of any suspected unauthorised use, and use the emergency-revoke link in our security-alert email if you receive one.
6.AS4000-1997 engagement (Partners)
Partners execute the AS4000-1997 General Conditions of Contract (as modified) by ticking the acceptance box during registration. Acceptance is captured with a timestamp and IP address and reproduced on the executed engagement PDF issued to the partner upon payment confirmation. The engagement PDF is the operative instrument governing the professional relationship between the partner and ACC.
7.Payment terms
All fees are shown in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. Card payments are processed by Stripe under Stripe's own terms; ACC does not store card details. Bank-transfer payments must include the exact reference issued by ACC so that funds can be matched to your registration. Membership does not activate until funds are confirmed.
8.Confidentiality & client portal
Content, drawings, cost plans, board reports and photos uploaded to a project workspace are confidential. Where a client portal is issued, access is controlled by tokenised share links with optional expiry and passcode. All downloads made through a client portal are watermarked with the client name, project name and download timestamp. You must not share portal links, credentials or downloaded documents outside the intended recipient group.
9.Acceptable use
You must not (a) upload malware, spam or unlawful content; (b) attempt to circumvent authentication, brute-force login endpoints, scrape data or otherwise interfere with the platform; (c) reverse-engineer, resell or sublicense the platform; or (d) use the platform in breach of any Australian or New South Wales law, including the Building and Construction Industry Security of Payment Act 1999 (NSW) or Work Health & Safety obligations. ACC may suspend or terminate access for a breach of this clause.
10.Intellectual property
All intellectual property in the platform, including the software, database structure, generated PDF layouts, AI prompts, standards library and clause references, is owned by or licensed to ACC. Standards published by Standards Australia (AS4300, AS4902, AS4000, AS/NZS series) and the National Construction Code are the property of their respective copyright holders — the platform stores clause references only, and any user-uploaded licensed standard PDFs remain your responsibility. You retain ownership of the project data you upload, and grant ACC a limited license to process it for the purpose of delivering the services.
11.AI-generated content
The platform includes AI features (board summaries, delay narratives, cash-flow forecasts, RFI responses, variation drafts, PDF drawing takeoffs) powered by third-party large-language and vision models. AI output is a decision-support draft only. You are responsible for reviewing all AI-generated content before relying on it in engineering, contractual or legal decisions. ACC does not warrant that AI output is complete, accurate or fit for any particular purpose.
12.Third-party services
The platform uses Stripe (payments), Emergent-managed Resend (transactional email), Emergent-managed Google Sign-In (authentication) and Emergent object storage (files). Use of these services is subject to their own terms. Availability of the platform depends on these providers being operational.
13.Warranty disclaimer & liability
To the maximum extent permitted by law, the platform is provided "as is" without warranties of merchantability, fitness for purpose or non-infringement. Nothing in these Terms excludes any consumer guarantee under the Australian Consumer Law that cannot be excluded. ACC's total liability for any claim arising from your use of the platform is limited to the fees you have paid in the twelve (12) months preceding the claim, or A$700, whichever is greater.
14.Termination
You may close a Partner or Subcontractor account from your dashboard at any time; card subscriptions cancel at the end of the current billing period. ACC may suspend or terminate any account with cause (e.g. non-payment, breach of these Terms) or without cause on 30 days' written notice. Termination does not entitle you to a refund of fees already paid, except as required by law.
15.Changes to these terms
We may update these Terms from time to time. Material changes will be notified by email to your account address and posted here with a new "Last updated" date. Continued use of the platform after the change constitutes acceptance of the updated Terms.
